Wills & Probate

Probate is usually the process of proving that a will is valid and then give rights to deal with a deceased person’s assets and estate. However, it will depend on whether there is a will. The process will be different, but the end results the same.  If there is a will, one or more executors are named in it.  Where there is no will then administrators will be appointed to deal with a deceased’s estate.

With a Power of Attorney, this can be used to give someone authority to make decisions immediately on your behalf or allow them to make decisions for you in the future if you become medically unfit to make decisions for yourself.  It can also grant a range of powers depending on your circumstances and can include financial powers as well as welfare powers.

Child Contact Arrangements

Whether you are married or not, when you separate with your partner you may need help making arrangements about the time your children spend with each parent.

Fees

– Initial free 20 minute call

– Hour advice followed up with written letter of advice £250 plus VAT

– To make an application to court and representation at the first hearing - £1500 plus VAT plus the court fee of £232

– Or you can choose to have legal advice and representation at the hourly rate of £275 plus VAT



Divorce and Financial Settlements

Our divorce costs will include drafting all the documents to be sent to the court at the appropriate time, all telephone calls and attendances and finally we will advise you briefly on your financial situation should you require initial advice, for all this our fees are £750 plus VAT plus £593.00 court fee.

If you are having trouble reaching a financial agreement with your soon to be ex and you need to make an application to the court. We can deal with every stage, we will refer you to mediation (which has to be attempted) and we will draft all the documents to the court when mediation fails.

We will complete your Form E and exchange these with the other side, thereafter we will raise questionnaires, complete other documents the court require before a first hearing and attend the first hearing all for a fixed rate of £3,500 plus VAT plus £275 court fee.

At that first hearing you may need a valuation of properties either of you may own and we can arrange this. We can also prepare the rest of the documents the court might need which includes replies to questionnaires. Once all the outstanding evidence has been filed we anticipate the matter can be settled and we will meet with you to make a proposal to settle in the hope further hearings and costs can be avoided. We will advise you on a suitable proposal and if we cannot reach an agreement we will either attend court or arrange a barrister all again for a fixed fee of £5,000 plus VAT plus valuation fees

Finally if an agreement cannot be reached and you are just too far apart in your offers the matter will go to a final hearing, this can be 2 or 3 days and whilst we aim to avoid them sometimes this cannot be achieved, we will continue to try and settle matters but we will also prepare bundles , statements and any other documents the court might require or order in preparation for a final hearing. We will also attend the hearing or arrange counsel to attend for a fixed fee of £9,500 plus VAT.

These fees are for straight forward financial matters without a pension sharing element or trusts or any other additional feature, however we will be able to give you fee estimates for the more complex cases, please do not hesitate to get in touch.
