Often the police will be called to a domestic incident and will say “oh see a solicitor about an injunction” and then we are asked “can you help me get a non-molestation order (commonly known as a restraining order)?”

If there has been domestic violence recently and the police do not have bail conditions in place then yes the court can look to protect you with an urgent non molestation order.

If however there has been no immediate violence or abuse then an injunction could still be obtained but this would not be an immediate application, this would be what we call on notice and the opponent would need to be served with a copy of the order before a court hearing takes place.
